By accessing or using ReserveIQ, you agree to be bound by these Terms & Conditions and any additional policies incorporated by reference. If you do not agree to these terms, you may not access or use the Service.
2. Description of Service
ReserveIQ is a software platform designed to help homeowners associations, board members, treasurers, community leaders, property managers, and related users organize financial information, analyze funding needs, review reserve-related projections, and generate reports and planning insights.
The Service may include features such as:
- Financial dashboards and balance summaries
- Reserve funding forecasts and scenario modeling
- Budget and spending analysis
- Board-facing summaries, reports, and decision-support narratives
- Document, project, and vendor-related organizational tools
3. No Financial, Legal, or Professional Advice
ReserveIQ is provided for informational and planning purposes only. The Service does not constitute legal, tax, accounting, investment, insurance, engineering, reserve specialist, or other professional advice.
Any output, recommendation, projection, chart, summary, or narrative generated by ReserveIQ is based on data, assumptions, and user inputs and should not be relied upon as the sole basis for board action or financial decisions.
Users are responsible for consulting qualified professionals, including attorneys, CPAs, reserve specialists, engineers, insurance professionals, and licensed advisors, where appropriate.
4. User Accounts and Eligibility
To use certain features of ReserveIQ, you may be required to create an account and provide accurate, current, and complete information.
You agree to:
- Maintain the confidentiality of your login credentials
- Promptly update account information when it changes
- Accept responsibility for activity occurring under your account
- Use the Service only for lawful and authorized purposes
You must be authorized to act on behalf of your HOA, management company, or organization if you are entering data, creating subscriptions, or using the platform in a business or board capacity.
5. User Responsibilities
You are solely responsible for the information you enter into the Service, including uploaded documents, account details, budgets, reserve information, invoices, contracts, financial statements, and related records.
You agree that you will not:
- Upload false, misleading, infringing, or unlawful content
- Attempt to interfere with or disrupt the Service
- Reverse engineer, copy, scrape, or exploit the platform beyond permitted use
- Use ReserveIQ to violate applicable laws, regulations, or governing documents
6. Subscription Terms
Certain features of ReserveIQ are available only through a paid subscription. Subscription plans, billing cycles, and included features may be described on the pricing or signup page.
By subscribing, you authorize ReserveIQ to charge the applicable subscription fees and any related taxes on a recurring basis, unless and until your subscription is canceled.
Subscription access continues for the purchased billing period and automatically renews unless canceled before the next renewal date.
7. Payments, Renewals, and Refunds
Fees are billed in advance on a recurring basis according to the subscription plan selected by the user.
- All fees are non-refundable except where required by law or expressly stated otherwise
- Failure to pay may result in suspension or termination of access
- ReserveIQ may change subscription pricing with reasonable prior notice
- Price changes will apply at the next renewal period unless otherwise stated
8. Data Ownership and License
You retain ownership of the data and materials you upload to the Service. By using ReserveIQ, you grant 369 Consulting LLC a limited, non-exclusive license to host, store, process, reproduce, and analyze your data solely for the purpose of operating, maintaining, securing, and improving the Service.
ReserveIQ may use aggregated and anonymized usage and performance data to improve the platform, provided that such use does not identify you, your HOA, or any individual resident.
ReserveIQ does not sell user financial data to third parties.
9. Data Accuracy, Assumptions, and Forecast Limitations
ReserveIQ depends on user-provided information, uploaded documents, assumptions, formulas, and forecasting models. Because projections involve uncertainty, ReserveIQ does not warrant that any result, recommendation, reserve projection, dues estimate, budget forecast, or scenario analysis will be complete, accurate, or predictive of future outcomes.
Users acknowledge that actual results may differ materially due to inflation, vendor pricing, deferred maintenance, emergencies, changes in scope, insurance events, legal requirements, market changes, or incomplete data.
10. Privacy and Security
Use of the Service is also subject to the ReserveIQ Privacy Policy. While ReserveIQ takes reasonable measures to protect user information, no internet-based service can guarantee absolute security.
You are responsible for controlling access to your account and for determining whether the data you upload may include sensitive, confidential, or regulated information.
11. Intellectual Property
ReserveIQ and all related software, branding, designs, content, code, workflows, models, graphics, page layouts, and platform functionality are the property of 369 Consulting LLC or its licensors and are protected by applicable intellectual property laws.
Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, sublicense, or create derivative works from the Service without prior written permission.
12. Service Availability and Changes
ReserveIQ may modify, suspend, or discontinue any aspect of the Service at any time, including features, subscription plans, integrations, or support offerings.
ReserveIQ does not guarantee uninterrupted or error-free availability and is not liable for delays, outages, maintenance periods, or data access interruptions.
13. Limitation of Liability
To the fullest extent permitted by law, 369 Consulting LLC, ReserveIQ, and their affiliates, officers, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, budgeting errors, reserve underfunding, missed opportunities, project delays, or business interruption arising from or related to the use of, or inability to use, the Service.
To the fullest extent permitted by law, the total cumulative liability of ReserveIQ for any claim arising out of or related to the Service shall not exceed the amount paid by you to ReserveIQ during the twelve (12) months preceding the event giving rise to the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless 369 Consulting LLC and its affiliates, officers, employees, contractors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your data, your violation of these Terms, or your violation of any law or third-party right.
15. Suspension and Termination
ReserveIQ may suspend or terminate your access to the Service at any time if you violate these Terms, fail to pay applicable fees, misuse the Service, or create risk or legal exposure for ReserveIQ or others.
You may stop using the Service and cancel your subscription according to the cancellation terms presented at signup or in your account settings.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict-of-law principles.
17. Changes to These Terms
ReserveIQ may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
